General Terms and Conditions of Sale

ARTICLE 1: DEFINITIONS

For the purpose of these general terms and conditions of sale, the terms used herein shall have the following meanings, whether used in the singular or plural form:

  • Customer”: the individual or entity who purchases a Product on the Website accessible at www.t-leclerc.com in a personal—not professional—capacity.
  • General Terms and Conditions”: these general terms and conditions of sale establishing the terms and conditions for the sale of Products to Customers by Maison Théophile LeClerc.
  • Account”: the Customer’s account created under the terms and conditions set forth in Article 4 of the General Terms and Conditions accessible from the Website.
  • Maison Théophile LeClerc”: the company Maison Théophile LeClerc, a simplified joint stock company with share capital of €100,000.00, registered with the Paris Trade & Companies Register under number 881,637,656 and whose registered office is located at 24 rue Erlanger, 75116 Paris, France.
  • Parties”: jointly Maison Théophile LeClerc and the Customer.
  • Website”: the website belonging to Maison Théophile LeClerc, accessible at the URL www.t-leclerc.com, where Customers can purchase the Products. The Website consists of both the infrastructure and the content, including the text, sounds, fixed and animated images, videos and databases.
  • Products”: the products for sale on the Website.

 

ARTICLE 2: PURPOSE – ENFORCEABILITY

The General Terms and Conditions establish the terms and conditions for the sale of Products by Maison Théophile LeClerc to Customers.

The General Terms and Conditions are always made known to Customers when placing an order. They apply exclusively to all orders of Products accepted by Maison Théophile LeClerc and prevail over all other terms and conditions, except those that Maison Théophile LeClerc has expressly accepted. Accordingly, all other terms and conditions are binding upon Maison Théophile LeClerc only after they have been confirmed in writing.

IMPORTANT: NOTE TO CUSTOMERS

ANY PRODUCT ORDER ON THE WEBSITE IMPLIES THE CUSTOMER’S EXPRESS, PRIOR, FULL AND COMPLETE ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS. THE CUSTOMER ACKNOWLEDGES THAT THEY ARE BOUND BY ALL THE GENERAL TERMS AND CONDITIONS, WHICH ARE AVAILABLE ON THE WEBSITE AND ACCEPTED BY THE CUSTOMER AT THE TIME OF THEIR ORDER.

Maison Théophile LeClerc reserves the right to modify the General Terms and Conditions at any time to accommodate any legal, jurisprudential, editorial, functional and/or technical developments. The version of the General Terms and Conditions of Sale that is accessible online on the day when the order is placed shall prevail. Any order placed by the Customer after the publication of modified General Terms and Conditions shall constitute the Customer’s acceptance of the new General Terms and Conditions.

 

ARTICLE 3: PRODUCT OFFERING – AVAILABILITY

3.1-Product information is provided by Maison Théophile LeClerc through its catalogues, sales documents and/or Website.

Maison Théophile LeClerc makes every effort to ensure that the graphical representation of the Products is as faithful to the Products as possible. However, the Customer’s perception may not accurately match reality. In such a situation, Maison Théophile LeClerc shall not be held liable, given that said graphical representations are not contractually binding.

 

3.2-Product offerings are valid worldwide, except in the United States of America, Brazil and Australia, for the entire validity period of the catalogues and/or sales documents and/or as long as they can be viewed on the Website, subject to their availability at the time when the order is received.

Product availability may change quickly in response to sales. Therefore, Maison Théophile LeClerc makes every effort to update Product availability information on a regular basis. Accordingly, Maison Théophile LeClerc shall not be held liable for failing to update inventory status information.

If a Product is unavailable after the order is placed, Maison Théophile LeClerc will notify the Customer by sending then an email with the new shipping date and/or offer a similar Product at the same price. In this situation, the Customer will have the option to accept this new date and/or cancel the order. Maison Théophile LeClerc will then refund the Customer no later than fourteen (14) days of their cancellation request.

 

3.3-Maison Théophile LeClerc reserves the right to modify the list of Products offered for sale, including due to constraints involving raw materials, without prejudice to orders placed by the Customer.

Moreover, because Products may be subject to change, Maison Théophile LeClerc reserves the right to modify Product specifications, characteristics and content if such modifications are the result of the implementation of any form of standards, legislation and regulations applicable to the Products. Such modifications and/or cancellations may occur at any time, without prior notice, including after the Customer places an order. In such a situation, Maison Théophile LeClerc will notify the Customer by any means. The Customer may then request a refund or select a product that is similar to the ordered Product.

 

ARTICLE 4: ACCOUNT CREATION

4.1-To place an order, the Customer may, if they choose to do so, create an account by clicking the “Create Account” tab.

They must then fill out the online registration form.

The Customer agrees to provide true, accurate, up-to-date and complete information about their identity, in accordance with Article 6-II of Law no. 2004-575 of 21 June 2004 relating to trust in the digital economy. They shall specifically agree not to create a false identity intended to mislead Maison Théophile LeClerc or others and not to steal the identity of another individual or entity. The Customer agrees to immediately update the provided data if it changes.

The Customer then receives an email confirming the creation of their Account.

 

4.2-If the Customer provides information that is false, inaccurate, erroneous, outdated, incomplete, deceptive or potentially misleading, Maison Théophile LeClerc may, immediately and without prior notice or indemnity, suspend or terminate their Account and temporarily or permanently deny them access to the Website. In addition, Maison Théophile LeClerc shall not be held liable for non-performance and/or partial performance of its obligations owing to the provision of such information.

 

4.3-The Customer can access the Account with their username and password, for which the Customer is exclusively responsible. The Customer agrees to keep these credentials confidential and not to disclose them in any form whatsoever. If any portion of their credentials is lost or stolen, the Customer must immediately notify Maison Théophile LeClerc, who will then cancel and/or update the relevant Account credentials. The Customer may also use the “Forgot password?” or “Change my password” function.

The Customer is solely responsible for keeping their password confidential. As such, the Customer must ensure that they log out of the Website at the end of each session, especially when accessing the Website from a public computer.

 

4.4-If they’ve lost their password, the Customer has the option to request a new one by clicking the “Forgot password?” link.

 

4.5-At any time necessary, the Customer may decide to deactivate their Account as set forth in Article 13 of the General Terms and Conditions.

 

ARTICLE 5: ORDERS

5.1-Customers wishing to place an order shall guarantee that they are acting in a personal capacity, on their own behalf, and that they are aged 18 or older, fully authorised to use the payment methods and have sufficient funds to cover all costs arising from the purchase of the Products.

Maison Théophile LeClerc reserves the right to reject orders from any Customers (i) if the Products designated by the Customer in their order are not available or (ii) if a dispute exists between the Customer and Maison Théophile LeClerc regarding a previous order and/or the payment of Maison Théophile LeClerc’s invoices.

 

5.2-The process of ordering is as follows:

  • The Customer views the Products.
  • They must then:
    • Select the Product(s) they want.
    • Create an Account or log in if they have previously registered. Creating an account is optional.
    • Confirm the billing address and shipping address.
  • The Client then sees a summary of their order and can verify the accuracy of the information (ordered products, identification, shipping address, etc.).
  • Finally, the Customer confirms their order.

 

5.3-The order will not be finalised until Maison Théophile LeClerc has received and collected the Customer’s payment, as stipulated in Article 7 of the General Terms and Conditions.

At the end of the order, Maison Théophile LeClerc automatically sends an order confirmation email to the Customer at the email address provided when the Customer created their Account or when placing and confirming their order.

Customers can track the status of their order in the “My Account/Orders” section of the Website.

 

ARTICLE 6: PRICES

6.1-Orders placed on the Website are subject to payment.

Product prices shown in the Product descriptions are denominated in euros, including all taxes and excluding shipping costs. Shipping costs depend on the weight of the Products and the country where they are to be delivered. This information is provided to the Customer before they confirm their order on the order summary page.

Shipping costs are as follows:

  • FREE SHIPPING FOR ANY ORDER OVER €49.99 (INCLUDING TAXES) TO MAINLAND FRANCE OR BELGIUM
  • FLAT FEE OF €5 FOR ANY ORDER UNDER €50.00 TO MAINLAND FRANCE OR BELGIUM
  • FOR ALL OTHER GEOGRAPHICAL AREAS, COLISSIMO CATALOGUE RATE FOR SHIPMENTS WITH OR WITHOUT A SIGNATURE:  See Colissimo rates (in French):

Prices include the applicable VAT as of the order date. Changes to the applicable rate may be reflected in Product prices after the effective date of the newly applicable rate. If such a situation arises, Maison Théophile LeClerc will notify Customers.

 

6.2-Maison Théophile LeClerc reserves the right to change the prices displayed on the Website at any time. In this situation, the Customer will be billed for the Products at the price in effect on the day when the order was placed.

Prices may also vary for business reasons (introductory prices, promotional prices and sales).

 

ARTICLE 7: PAYMENT

7.1-Payment methods

Orders placed on the Website are payable:

  • By bank card or credit card (debit card, Visa card, Eurocard, Mastercard). The Customer’s card number and expiry date are entered on the Stripe server, which keeps the data secure and confidential. None of the Customer’s bank information is transmitted over the Website. The payment is made directly to the bank.
    Maison Théophile LeClerc has no access to this data at any time and does not store it on its servers. This is why Customers are asked for their payment information with each new transaction.
  • By PayPal.

 

7.2-Payment date – Effective order date

For a bank card payment, the Customer’s account will be debited for the amount of their purchase when their payment is validated. The order is then finalised.

For a PayPal payment, the transaction is complete when the money is received by Maison Théophile LeClerc. The order is finalised from this date, and shipping times are calculated.

 

7.3-Failed payments – Payment delays

If a debit card payment or other payment method fails, the order is not finalised. The Customer must then contact Maison Théophile LeClerc to pay for their order by any method. Furthermore, if necessary, Maison Théophile LeClerc reserves the right to cancel the Customer’s order without being held liable.

 

7.4–Reservation of ownership

MAISON THÉOPHILE LECLERC RESERVES OWNERSHIP OF SHIPPED PRODUCTS UNTIL PAYMENT OF THE ENTIRE PRINCIPAL, INTEREST AND ACCESSORY PRICE IS COMPLETE UNDER THE TERMS AND CONDITIONS SET FORTH IN ARTICLES 2367 TO 2372 OF THE FRENCH CIVIL CODE.

RECEIPT OF A DOCUMENT CREATING AN OBLIGATION TO PAY SHALL NOT CONSTITUTE A PAYMENT. FAILURE TO PAY BY ANY OF THE DUE DATES OR PARTIAL PAYMENT OF THE PRICE MAY RESULT IN THE PRODUCTS SOLD BEING CLAIMED, WITHOUT THE NEED FOR PRIOR NOTICE.

THE ABOVE PROVISIONS SHALL NOT PREVENT THE RISK OF LOSS AND/OR DETERIORATION OF THE PRODUCTS SOLD, INCLUDING THE RISK OF POTENTIAL DAMAGE, FROM BEING TRANSFERRED TO THE CUSTOMER WHEN THE PRODUCTS ARE SHIPPED.

UNLESS ACCEPTING LIABILITY, THE CUSTOMER AGREES TO NOTIFY Maison Théophile LeClerc IMMEDIATELY OF ANYTHING PREVENTING THEM FROM THE FULL USE OF THE PRODUCTS.

 

ARTICLE 8: PRODUCT SHIPPING

8.1-Shipping method

Products ordered by the Customer will be shipped by Colissimo to the address provided at the time of order.

Maison Théophile LeClerc reminds Customers that:

  • The shipping address provided at the time of order (which may be different from the billing address) must be accurate and include all details needed for delivery.
  •  The Customer shall be responsible for any new shipment resulting from an error in the information needed for delivery, such as the shipping address, the delivery location, the location’s accessibility and/or the Customer’s absence. Furthermore, if necessary, Maison Théophile LeClerc reserves the right to cancel the order.

 

8.2–Shipping times

The Customer will be notified of shipping times again when the order is finalised and in a confirmation email sent to them.

Regardless of how the order was placed, shipping times are established from the date when the order is finalised.

For an order placed by the Customer for Products that may be shipped on different dates, according to their availability, the shipping time will reflect the longest time.

 

8.3–Shipping delays – Shipping problems

The Customer is urged to notify Maison Théophile LeClerc if shipping is delayed (within thirty (30) days from the order date).

In addition, if there is a shipping delay and/or a lack of Product availability within the indicated time period, as set forth by Article L.216-2 of the French Consumer Code:

  • If the shipping time was an essential condition of the sale for the Customer when they placed the order, due to the Customer’s circumstances or express request prior to placing the order, they may then cancel it.
  • Otherwise, the Customer may contact Maison Théophile LeClerc to ask that the order be fulfilled within a reasonable additional period of time by sending their request by a durable medium, such as by registered post with acknowledgement of receipt, to the following address: Maison Théophile LeClerc – AFTER-SALES SERVICE – 24 rue Erlanger, 75016 Paris - France

If Maison Théophile LeClerc still does not fulfil the order within a reasonable additional period of time, as agreed by the Customer for shipment, the Customer shall have the option of notifying Maison Théophile LeClerc (by the same methods as those implemented to agree upon the reasonable period of time) that they would like to rescind the order.

The order will then be considered rescinded upon Maison Théophile LeClerc’s receipt of the letter or written notification of such rescission, unless Maison Théophile LeClerc has already fulfilled the order in the meantime.

If the Customer receives the Products after having requested a cancellation, they should refuse them with a note stating “refused due to delay-related cancellation”.

Maison Théophile LeClerc will then process a refund for the Products and return costs, if any, no later than fourteen (14) days following the date when the order was revoked by the Customer.

If the shipping delay is a result of a case of force majeure within the meaning established by French case law, Maison Théophile LeClerc will notify the Customer by email that the cancellation request cannot be honoured.

Maison Théophile LeClerc’s customer service department is closed annually from 1 August to 20 August. All orders submitted within three business days before the closure begins will be fulfilled when the customer service department reopens.

 

8.4–Product packaging

Products are packaged in accordance with applicable shipping standards for maximum protection. It is recommended that Customers follow these same standards when returning a Product after cancelling their order and/or when exercising their right of withdrawal.

 

8.5–Shipment tracking / Product availability

Registered Customers may view the status of their order on the Website at any time through their Account or the Colissimo tracking website. Tracking allows the Customer to know the processing status of their order, as well as the shipping and delivery status of their Products.

 

8.6–Product verification

Each delivery is deemed complete when the Product(s) are made available to the Customer.

Without prejudice to the time available to the Customer as part of their right of withdrawal, as established in Article 9 of the General Terms and Conditions, the Customer must check shipments upon receipt and state all reservations and claims that may be justified. They may even refuse the parcel if it shows signs of having been opened or obvious signs of deterioration.

within three (3) business days following the receipt of the Products.

In this notification, the Customer must provide evidence of the reality of the noted problems.

If a non-compliance is found and Maison Théophile LeClerc agrees to take back the Product, Maison Théophile LeClerc will ship the same Product subject to availability. Otherwise, the Customer may request that their order be cancelled and that they receive either a refund or another Product of the same price.

 

ARTICLE 9: RIGHT OF WITHDRAWAL

9.1–Principe

In accordance with Article L.221-18 of the French Consumer Code, the Customer has a withdrawal period of fourteen (14) calendar days from the day when they receive the Products to return the Products without needing to provide a reason or pay any penalties.

However, in application of Article L.221-28 of the French Consumer Code, the withdrawal period shall not apply for products that have been opened after receipt and that cannot be returned due to health or sanitary reasons, such as cosmetics.

 

9.2–Exercising the right of withdrawal

Withdrawal requests can be submitted:

Maison Théophile LeClerc will send the Customer an acknowledgement of having received their withdrawal request.

 

9.3–Effects of exercising the right of withdrawal

Products for which the right of withdrawal has been exercised must be returned by the Customer intact, complete (including all accessories, packaging, instructions, samples and other related elements) and properly protected to Maison Théophile LeClerc – AFTER-SALES SERVICE – 24 rue Erlanger, 75016 Paris - FRANCE, under any circumstance, no later than fourteen (14) days following the withdrawal request. The Customer shall be held liable if the Product has depreciated due to handling beyond what is necessary to establish the nature and/or characteristics of the Product.

The Customer shall be responsible for the direct costs of returning the Product and all risks associated with the return.

Maison Théophile LeClerc will issue a refund for Products for which the right of withdrawal has been implemented and, if applicable, shipping costs, as soon as possible, no later than fourteen (14) days following the date when they were notified of the Customer’s wish to withdraw. The refund date may be delayed until the Product has been received by Maison Théophile LeClerc or the Customer has provided proof of the shipment to Maison Théophile LeClerc, whichever date comes first.

Maison Théophile LeClerc will not be required to reimburse the Customer for additional expenses resulting from the Customer’s decision to use a more expensive shipping method than the standard shipping method offered by Maison Théophile LeClerc.

The refund will be issued by the same payment method as was used by the Customer for their order, unless the Customer expressly agrees to the use of another payment method.

 

ARTICLE 10: WARRANTIES CONCERNING THE T.LECLERC RANGE OF ACCESSORIES

In accordance with legal provisions (Articles L.217-4 of the French Consumer Code and 1641 of the French Civil Code, as reproduced in the appendix), Customers shall receive legal warranties of compliance and protection against hidden defects for orders placed on the Website.

When acting on the basis of the legal warranty of compliance, the Customer is hereby notified that:

  • They have a period of two (2) years from their receipt of the Product to act;
  • They may choose between having the Product repaired or replaced, subject to the cost terms established by Article L.217-9 of the French Consumer Code;
  • They are exempt from having to prove the existence of the Product’s non-compliance for twenty-four (24) months following receipt of the Product.

This legal warranty applies independently of any and all commercial warranties on the Products. The Customer may decide to invoke the warranty due to hidden defects on the sold item under Article 1641 of the French Civil Code, and as such, they may choose between rescinding the sale or lowering the sales price in accordance with Article 1644 of the French Civil Code.

Any legal warranty requests should be sent to Maison Théophile LeClerc – AFTER-SALES SERVICE – 24 rue Erlanger, 75016 Paris - FRANCE.

If the legal warranties are invoked, the Products must be returned in complete condition (including all accessories, packaging, instructions, samples and other related elements). The Customer will be reimbursed for shipping costs at the billed rate, and return costs will be reimbursed when supporting documents are provided.

In any case, these provisions do not waive the Customer’s right of withdrawal, as outlined by the provisions of Article 9 of the General Terms and Conditions.

The Seller’s warranty does not cover the following:

  • abnormal use or mishandling of the Products;
  • force majeure ;
  • installations that do not comply with the Supplier’s specifications;
  • commercial or collective use;
  • a repair or alteration carried out by a third party not approved by the Supplier.


 

ARTICLE 11 :LIABILITY

The offered Products comply with French legal and regulatory provisions.

Therefore, Maison Théophile LeClerc shall in no way be held liable for a failure to comply with the laws of the country to which the Product is shipped.

The Customer is solely responsible for verifying the ability to import and/or use the Products in the territory to which they are shipped if not subject to French regulations.

 

ARTICLE 12 :INTELLECTUAL PROPERTY

Some elements (including editorials, illustrations, studies and videos) appearing on the Website are protected under intellectual property laws, including copyright, and are the exclusive property of Maison Théophile LeClerc and/or the Suppliers.

In addition, the trademarks, logos, graphics and animations contained on the Website are the exclusive property of Maison Théophile LeClerc and/or the Suppliers.

It is agreed that the General Terms and Conditions shall not result in any transfer of intellectual property rights from Maison Théophile LeClerc with respect to intellectual property elements that may be used on the Website.

Customers are prohibited from any reproduction or use of studies, videos, trademarks, logos or generally any content from the Website without the express prior written authorisation of Maison Théophile LeClerc.

 

ARTICLE 13 :ACCOUNT DEACTIVATION

Registration on the Website has no time limit. The registered Customer’s Account shall therefore remain active as long as the Customer is registered on the Website.

The Customer shall retain the ability to suspend their account on the Website at any time, without reason, by submitting a request to Maison Théophile LeClerc to deactivate their account through the Contact form. They may be asked for a copy of their ID to prevent identity theft.

 

ARTICLE 14 :WEBSITE ACCESS

The Website is accessible seven (7) days a week and twenty-four (24) hours a day.

Maison Théophile LeClerc makes every effort to keep the Website operational as part of an obligation of means. However, due to the nature of the internet, Maison Théophile LeClerc makes no guarantees regarding the operation of and access to the Website seven (7) days a week and twenty-four (24) hours a day.

Maison Théophile LeClerc reserves the right to suspend the operation of the Website and/or access to the Account at any time, with or without notification, including for the performance of corrective and ongoing maintenance of the Website or to change its content or update its look and feel. To the greatest extent possible, Maison Théophile LeClerc will notify the Customer prior to any corrective or ongoing maintenance operation.

Also, the Customer is hereby informed that access to the Website may be suspended for reasons outside the control of Maison Théophile LeClerc, and therefore Maison Théophile LeClerc cannot guarantee continuous access to the Website and/or Account.

 

ARTICLE 15 :PROCESSING OF PERSONAL DATA

When browsing the Website, the Customer is asked to provide personal data.

The relevant provisions are available in the Website’s privacy policy.

As such, data collected by Maison Théophile LeClerc is used for the purposes and duration outlined in the privacy policy. Specifically, it is intended to help Maison Théophile LeClerc and its service providers to fill orders.

In accordance with the “Information Technology, Data Files and Civil Liberties” Act of 6 January 1978 and (EU) Regulation 2016/679 on personal data protection, Customers have a right to access, update, rectify, limit, transfer and delete personal data relating to them.

ARTICLE 16 :APPLICABLE LAW – DISPUTES

16.1-The General Terms and Conditions are subject to French law.

When a problem arises, the Customer must first contact Customer Service to reach an amicable solution through the Contact form.

16.2-In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, Customers have the option to refer the dispute to a mediator.

 


 

ANNEXES

DROIT DE RÉTRACTATION

Article L.221-18 du Code de la consommation

« Le consommateur dispose d’un délai de quatorze jours pour exercer son droit de rétractation d’un contrat conclu à distance, à la suite d’un démarchage téléphonique ou hors établissement, sans avoir à motiver sa décision ni à supporter d’autres coûts que ceux prévus aux articles L.221-23 à L.221-25.

Le délai mentionné au premier alinéa court à compter du jour :

1° De la conclusion du contrat, pour les contrats de prestation de services et ceux mentionnés à l’article L.221-4 ;
2° De la réception du bien par le consommateur ou un tiers, autre que le transporteur, désigné par lui, pour les contrats de vente de biens. Pour les contrats conclus hors établissement, le consommateur peut exercer son droit de rétractation à compter de la conclusion du contrat.

Dans le cas d’une commande portant sur plusieurs biens livrés séparément ou dans le cas d’une commande d’un bien composé de lots ou de pièces multiples dont la livraison est échelonnée sur une période définie, le délai court à compter de la réception du dernier bien ou lot ou de la dernière pièce.

Pour les contrats prévoyant la livraison régulière de biens pendant une période définie, le délai court à compter de la réception du premier bien ».

 

Article L.242-3 du Code de la consommation

« Est nulle toute clause par laquelle le consommateur abandonne son droit de rétractation défini à l’article L.221-18 ».

 

Article L.221-20 du Code de la consommation

« Lorsque les informations relatives au droit de rétractation n’ont pas été fournies au consommateur dans les conditions prévues au 2° de l’article L.221-5, le délai de rétractation est prolongé de douze mois à compter de l’expiration du délai de rétractation initial, déterminé conformément à l’article L.221-18.

Toutefois, lorsque la fourniture de ces informations intervient pendant cette prolongation, ledélai de rétractation expire au terme d’une période de quatorze jours à compter du jour où le;consommateur a reçu ces informations ».

 

Article L.221-21 du Code de la consommation

« Le consommateur exerce son droit de rétractation en informant le professionnel de sa décision de se rétracter par l’envoi, avant l’expiration du délai prévu à l’article L.221-18, du formulaire de rétractation mentionné au 2° de l’article L.221-5 ou de toute autre déclaration, dénuée d’ambiguïté, exprimant sa volonté de se rétracter.

Le professionnel peut également permettre au consommateur de remplir et de transmettre en ligne, sur son site internet, le formulaire ou la déclaration prévus au premier alinéa. Dans cette hypothèse, le professionnel communique, sans délai, au consommateur un accusé de réception de la rétractation sur un support durable ».

 

Article L.221-22 du Code de la consommation

« La charge de la preuve de l’exercice du droit de rétractation dans les conditions prévues à l’article L. 221-21 pèse sur le consommateur ».

 

Article L.211-23 du Code de la consommation

« Le consommateur renvoie ou restitue les biens au professionnel ou à une personne désignée par ce dernier, sans retard excessif et, au plus tard, dans les quatorze jours suivant la communication de sa décision de se rétracter conformément à l’article L.221-21, à moins que le professionnel ne propose de récupérer lui-même ces biens.

Le consommateur ne supporte que les coûts directs de renvoi des biens, sauf si le professionnel accepte de les prendre à sa charge ou s’il a omis d’informer le consommateur que ces coûts sont à sa charge. Néanmoins, pour les contrats conclus hors établissement, lorsque les biens sont livrés au domicile du consommateur au moment de la conclusion du contrat, le professionnel récupère les biens à ses frais s’ils ne peuvent pas être renvoyés normalement par voie postale en raison de leur nature.

La responsabilité du consommateur ne peut être engagée qu’en cas de dépréciation des biens résultant de manipulations autres que celles nécessaires pour établir la nature, les caractéristiques et le bon fonctionnement de ces biens, sous réserve que le professionnel ait informé le consommateur de son droit de rétractation, conformément au 2° de l’article L.221-5. ».

 

Article L.221-24 du Code de la consommation

« Lorsque le droit de rétractation est exercé, le professionnel rembourse le consommateur de la totalité des sommes versées, y compris les frais de livraison, sans retard injustifié et au plus tard dans les quatorze jours à compter de la date à laquelle il est informé de la décision du consommateur de se rétracter.
Pour les contrats de vente de biens, à moins qu’il ne propose de récupérer lui-même les biens, le professionnel peut différer le remboursement jusqu’à récupération des biens ou jusqu’à ce que le consommateur ait fourni une preuve de l’expédition de ces biens, la date retenue étant celle du premier de ces faits.
Le professionnel effectue ce remboursement en utilisant le même moyen de paiement que celui utilisé par le consommateur pour la transaction initiale, sauf accord exprès du consommateur pour qu’il utilise un autre moyen de paiement et dans la mesure où le remboursement n’occasionne pas de frais pour le consommateur.

Le professionnel n’est pas tenu de rembourser les frais supplémentaires si le consommateur a expressément choisi un mode de livraison plus coûteux que le mode de livraison standard proposé par le professionnel ».

 

Article L.242-4 du Code de la consommation

« Lorsque le professionnel n’a pas remboursé les sommes versées par le consommateur, les sommes dues sont de plein droit majorées du taux d’intérêt légal si le remboursement intervient au plus tard dix jours après l’expiration des délais fixés aux premier et deuxième alinéas de l’article L.221-24, de 5% si le retard est compris entre dix et vingt jours, de 10% si le retard est compris entre vingt et trente jours, de 20% si le retard est compris entre trente et soixante jours, de 50% entre soixante et quatre-vingt-dix jours et de cinq points supplémentaires par nouveau mois de retard jusqu’à concurrence du prix du produit, puis du taux d’intérêt légal ».

 

Article L.221-25 du Code de la consommation

« Si le consommateur souhaite que l’exécution d’une prestation de services ou d’un contrat mentionné au premier alinéa de l’article L.221-4 commence avant la fin du délai de rétractation mentionné à l’article L.221-18, le professionnel recueille sa demande expresse par tout moyen pour les contrats conclus à distance et sur papier ou sur support durable pour les contrats conclus hors établissement.

Le consommateur qui a exercé son droit de rétractation d’un contrat de prestation de services ou d’un contrat mentionné au premier alinéa de l’article L.221-4 dont l’exécution a commencé, à sa demande expresse, avant la fin du délai de rétractation verse au professionnel un montant correspondant au service fourni jusqu’à la communication de sa décision de se rétracter ; Ce montant est proportionné au prix total de la prestation convenu dans le contrat. Si le prix total est excessif, le montant approprié est calculé sur la base de la valeur marchande de ce qui a été fourni.

Aucune somme n’est due par le consommateur ayant exercé son droit de rétractation si sa demande expresse n’a pas été recueillie en application du premier alinéa ou si le professionnel n’a pas respecté l’obligation d’information prévue au 4° de l’article L.221-5 ».

 

Article L.221-26 du Code de la consommation

« Le consommateur qui a exercé son droit de rétractation d’un contrat de fourniture de contenu numérique non fourni sur un support matériel n’est redevable d’aucune somme si :

1° Le professionnel n’a pas recueilli son accord préalable exprès pour l’exécution du contrat avant la fin du délai de rétractation ainsi que la preuve de son renoncement à son droit de rétractation ;

2° Le contrat ne reprend pas les mentions prévues au deuxième alinéa des articles L.221-9 et L.221-13 ».

 

Article L.221-27 du Code de la consommation

« L’exercice du droit de rétractation met fin à l’obligation des parties soit d’exécuter le contrat à distance ou le contrat hors établissement, soit de le conclure lorsque le consommateur a fait une offre.

L’exercice du droit de rétractation d’un contrat principal à distance ou hors établissement met automatiquement fin à tout contrat accessoire, sans frais pour le consommateur autres que ceux prévus aux articles L.221-23 à L.221-25 ».

 

Article L.221-28 du Code de la consommation

« Le droit de rétractation ne peut être exercé pour les contrats :

1° De fourniture de services pleinement exécutés avant la fin du délai de rétractation et dont l’exécution a commencé après accord préalable exprès du consommateur et renoncement exprès à son droit de rétractation ;

2° De fourniture de biens ou de services dont le prix dépend de fluctuations sur le marché financier échappant au contrôle du professionnel et susceptibles de se produire pendant le délai de rétractation ;

3° De fourniture de biens confectionnés selon les spécifications du consommateur ou nettement personnalisés ;

4° De fourniture de biens susceptibles de se détériorer ou de se périmer rapidement ;

5° De fourniture de biens qui ont été descellés par le consommateur après la livraison et qui ne peuvent être renvoyés pour des raisons d’hygiène ou de protection de la santé ;

6° De fourniture de biens qui, après avoir été livrés et de par leur nature, sont mélangés de manière indissociable avec d’autres articles ;

7° De fourniture de boissons alcoolisées dont la livraison est différée au-delà de trente jours et dont la valeur convenue à la conclusion du contrat dépend de fluctuations sur le marché échappant au contrôle du professionnel ;

8° De travaux d’entretien ou de réparation à réaliser en urgence au domicile du consommateur et expressément sollicités par lui, dans la limite des pièces de rechange et travaux strictement nécessaires pour répondre à l’urgence ;

9° De fourniture d’enregistrements audio ou vidéo ou de logiciels informatiques lorsqu’ils ont été descellés par le consommateur après la livraison ;

10° De fourniture d’un journal, d’un périodique ou d’un magazine, sauf pour les contrats d’abonnement à ces publications ;

11° Conclus lors d’une enchère publique ;

12° De prestations de services d’hébergement, autres que d’hébergement résidentiel, de services de transport de biens, de locations de voitures, de restauration ou d’activités de loisirs qui doivent être fournis à une date ou à une période déterminée ;

13° De fourniture d’un contenu numérique non fourni sur un support matériel dont l’exécution a commencé après accord préalable exprès du consommateur et renoncement exprès à son droit de rétractation ».

 

GARANTIE LÉGALE DE CONFORMITÉ

Article L.217-4 Code de la consommation

« Le vendeur livre un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance. Il répond également des défauts de conformité résultant de l’emballage, des instructions de montage ou de l’installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité ».

 

Article L.217-5 Code de la consommation

« Le bien est conforme au contrat :
1° S’il est propre à l’usage habituellement attendu d’un bien semblable et, le cas échéant :
– s’il correspond à la description donnée par le vendeur et possède les qualités que celui-ci a présentées à l’acheteur sous forme d’échantillon ou de modèle ;
– s’il présente les qualités qu’un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l’étiquetage ;

2° Ou s’il présente les caractéristiques définies d’un commun accord par les parties ou est propre à tout usage spécial recherché par l’acheteur, porté à la connaissance du vendeur et que ce dernier a accepté ».

 

Article L.217-12 Code de la consommation

« L’action résultant du défaut de conformité se prescrit par deux ans à compter de la délivrance du bien ».

 

Article L.217-16 Code de la Consommation

« Lorsque l’acheteur demande au vendeur, pendant le cours de la garantie commerciale qui lui a été consentie lors de l’acquisition ou de la réparation d’un bien meuble, une remise en état couverte par la garantie, toute période d’immobilisation d’au moins sept jours vient s’ajouter à la durée de la garantie qui restait à courir.

Cette période court à compter de la demande d’intervention de l’acheteur ou de la mise à disposition pour réparation du bien en cause, si cette mise à disposition est postérieure à la demande d’intervention ».

 

GARANTIE DES VICES CACHÉS

Article 1641 Code civil

« Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l’usage auquel on la destine, ou qui diminuent tellement cet usage, que l’acheteur ne l’aurait pas acquise, ou n’en aurait donné qu’un moindre prix, s’il les avait connus ».

 

Article 1648 alinéa 1er Code civil

« L’action résultant des vices rédhibitoires doit être intentée par l’acquéreur dans un délai de deux ans à compter de la découverte du vice ».
